These Merchant Terms and Conditions (“Agreement”) apply to your participation as a merchant partner (“Merchant”, “you”, “your”) on the GoGetMe platform, operated by GoGetMe (“we”, “us”, “our”).
By joining the GoGetMe network and using our services, you agree to comply with the following terms and conditions.
1. Relationship Between the Parties
1.1 GoGetMe provides a digital platform that allows customers to browse, order, and pay for products (including food and drink) from local merchants.
1.2 This Agreement creates a commercial services relationship, not an employment, franchise, joint venture, or agency relationship. You remain fully responsible for your business operations, staff, and premises.
2. Your Responsibilities as a Merchant
2.1 You agree to:

Provide accurate and up-to-date menus, prices, and product descriptions.

Ensure food and products meet all applicable hygiene, safety, and quality standards.

Prepare all accepted orders within agreed timeframes.

Handle orders and customer service issues professionally.
2.2 You are responsible for:

Complying with applicable food, health, safety, and trading laws.

Holding and maintaining all required licences, permits, and insurance.

Your staff, packaging, and equipment used for fulfilling orders.
3. Orders and Fulfilment
3.1 Customers place orders via the GoGetMe platform. When you accept an order, you enter a contract of sale directly with the customer. GoGetMe acts as your disclosed commercial agent in facilitating the transaction.
3.2 You must only accept orders that you can fulfil and mark them as "ready" in the platform once prepared.
3.3 Orders must be accurate and safely packaged to avoid spillage or damage.
4. Menu, Pricing, and Inventory
4.1 You are responsible for maintaining your menu on the platform, including:

Accurate prices (inclusive of VAT)

Item availability

Ingredients and allergen information
4.2 You must notify GoGetMe promptly of any changes to your offerings or operating hours.
5. Payments and Fees
5.1 GoGetMe collects payment from the customer on your behalf. Net payouts (after applicable commission and fees) are transferred to your nominated bank account weekly.
5.2 Commission and service fees are agreed in writing and may vary depending on services provided (e.g. delivery vs collection).
5.3 A breakdown of transactions, charges, and payouts will be available via your merchant dashboard.
6. Point of Sale (POS) Terminals and Equipment
6.1 If GoGetMe provides a POS terminal, printer, tablet, or other hardware to assist with receiving and processing orders:

The device(s) remain the property of GoGetMe at all times.

You must take reasonable care of all provided equipment.

You may not sell, modify, or lend the equipment to third parties.
6.2 Upon termination of this Agreement, or if you stop accepting orders for more than 30 consecutive days:

You must return all GoGetMe-owned equipment within 7 days.

Failure to return equipment in working condition may result in charges or deductions from your final payment.
7. Delivery and Logistics
7.1 If you use GoGetMe delivery services:

You are responsible for preparing orders on time.

GoGetMe will arrange a rider to collect and deliver the order.
7.2 If you provide your own delivery:

You are solely responsible for the safe and timely delivery of orders.
8. Customer Issues and Refunds
8.1 GoGetMe manages customer complaints and refund requests on your behalf. If an issue is deemed to be due to your error (e.g. incorrect or missing items), you may be responsible for the refund value.
8.2 Repeated quality issues or customer complaints may lead to a review or suspension of your account.
9. Data Protection
9.1 You agree to comply with applicable UK data protection laws (including the UK GDPR) when handling any customer data provided for order fulfilment.
9.2 You must not retain or use customer data for any purpose other than completing the specific order.
10. Branding and Marketing
10.1 You grant GoGetMe a non-exclusive, royalty-free licence to use your name, logo, menu, and photos to promote your business via our platform and marketing materials.
10.2 You may not use GoGetMe’s branding without written permission.
11. Termination
11.1 You may terminate this Agreement with 7 days' notice.
11.2 GoGetMe may suspend or terminate your access to the platform:

For serious or repeated breaches of this Agreement.

If you fail to return POS equipment.

If you cease trading or become insolvent.
11.3 On termination, any outstanding payments will be settled and all equipment must be returned.
12. Liability
12.1 GoGetMe is not liable for:

Your food/product quality, safety, or delivery delays (if you self-deliver).

Loss of business, profits, or indirect damages.
12.2 Our total liability under this Agreement is limited to the total commission we earned from your orders over the 30 days prior to the incident.
13. Amendments
We may update these terms at any time. We’ll notify you via email or through your merchant portal. Continued use of the platform indicates your acceptance of any changes.
14. Governing Law and Jurisdiction
This Agreement is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
